
Family of Stirling Crash Victim Kyle Marshall Sues Acquitted Driver Charles Gray
The family of Kyle Marshall, who died in a fatal car collision two years ago in Stirling, has initiated a civil claim against Charles Gray, the driver involved. Mr Gray was previously acquitted of causing death by dangerous driving in connection with the incident that also resulted in the death of another teenager.
Kyle Marshall, 16, and Amber Gibson, 16, were passengers in a car driven by Mr Gray when it lost control and collided with trees near the entrance to Stirling University in October 2022. Kyle Marshall died at the scene. Ms Gibson passed away in hospital four days later.
A spokesperson for Mr Marshall's family confirmed their intent to proceed with a civil action, stating, "We are bringing a civil action against Charles Gray. Kyle was loved by his family and friends, and we continue to miss him every day."
At the High Court in Glasgow in December 2023, Mr Gray was found not guilty of causing death by dangerous driving and causing serious injury by dangerous driving. The jury delivered their verdict after a trial that scrutinised the circumstances of the fatal crash.
The pursuit of a civil claim, even after a criminal acquittal, is a legal avenue for families seeking recompense for loss and suffering, operating under a different burden of proof than criminal proceedings.
