Financial Conduct Authority Sanctions Early Compensation for Car Finance Mis-Selling
The Financial Conduct Authority (FCA) has endorsed the practice of car finance companies offering pre-emptive compensation to customers who may have been mis-sold agreements. This guidance follows the FCA's ongoing investigation into discretionary commission arrangements, which were prevalent before a 2021 ban. The regulator stressed that any early offers must be equitable and ensure customers are not disadvantaged by accepting them.
Several lenders have already commenced issuing such offers. The FCA's investigation, launched in January, focuses on whether consumers were overcharged due to incentives paid to brokers and dealers. This extensive review could ultimately lead to significant redress payments for millions of motorists across the UK.
The regulator's announcement aims to clarify the position for both consumers and finance providers, indicating a pathway for resolution even as the comprehensive investigation continues. However, the FCA maintains that firms must thoroughly assess their past sales and accurately calculate any compensation due, irrespective of early settlement offers.
