Texas Family Sues Tesla After Elderly Woman Killed in Home Crash
A Texas family has launched a lawsuit against Tesla, following a fatal incident where a Tesla Model 3 careened into their home in October 2022, resulting in the death of a 75-year-old woman.
The family of the deceased, identified as Martha Delgado, alleges that the vehicle suffered from design defects and that Tesla was negligent. According to the lawsuit, the Model 3, driven by Delgado's son-in-law, suddenly and uncontrollably accelerated as he attempted to park, despite his efforts to engage the brakes.
The incident, which occurred in Dallas, saw the vehicle crash directly into the residence, causing Mrs. Delgado's death. The driver, attempting to park in the driveway, reportedly experienced a 'sudden unintended acceleration', a phenomenon Tesla has previously faced scrutiny over.
Tesla has consistently maintained that such incidents are attributable to driver error, specifically the misapplication of the accelerator pedal instead of the brake. However, the family's legal representation contests this, asserting that evidence supports a defect in the vehicle's design or manufacturing.
This legal challenge adds to a growing number of lawsuits and regulatory examinations concerning Tesla's vehicle safety and its advanced driver-assistance systems, particularly relating to unintended acceleration claims and Autopilot functionalities. The outcome of this case could further influence the ongoing debate surrounding the liabilities of autonomous and semi-autonomous vehicle technology.
