Driver Jailed Eight Years for A12 Crash Death While Using TikTok, Other Apps
A 22-year-old man, Ismaeel Malik of Bledlow Ridge, High Wycombe, has been jailed for eight years following a fatal collision on the A12 near Kelvedon, Essex, in October 2024. Malik admitted to causing death by dangerous driving, having been distracted by his mobile phone, including watching TikTok videos, at the moment his vehicle struck a stationary car.
Norman Case, 58, of Tolleshunt Major, died of severe head injuries after Malik’s black Mercedes collided with the rear of his vehicle at approximately 70mph (113km/h). Prosecutors at Chelmsford Crown Court confirmed that the TikTok application was active just after 09:30 GMT on 22 October 2024. During police interviews, Malik acknowledged the videos were playing but claimed he was not distracted.
Judge Mary Loram described the incident as a "devastating demonstration of just how dangerous it is to use mobile phones whilst driving." Analysis showed Malik had used WhatsApp, X, and Waze almost 100 times during his two-hour drive that morning. Despite clear visibility of over 300m (984ft) and nearly ten seconds to react to the halted traffic, Malik made no attempt to brake, only swerving to the left too late. His claim of brake failure was disproven by subsequent vehicle analysis.
Over 30 victim impact statements were submitted by Mr Case's family and friends. His daughter, Kate, stated, "I always believe in forgiveness, but I cannot comprehend how such a selfish act should be forgiven." Mr Case's wife, Sarah, spoke of her heartbreak, pondering his final moments. Malik was also disqualified from driving for over ten years.
