A woman has secured a significant victory in the Court of Appeal, overturning a Family Court judge's dismissal of her rape allegations against her former partner. The appellate court found that Judge Robin Tolson KC's decision contained "serious procedural unfairness" and demonstrated an "impermissible closed mind" regarding her testimony.
The original family court proceedings had dismissed the mother's claims of rape and controlling behaviour, finding them unsubstantiated. However, the Court of Appeal criticised Judge Tolson for failing to provide adequate reasoning for his conclusions and for a perceived lack of impartiality when evaluating her evidence.
